That is part of the outrageous outcome of the widely discussed trial of Maxim Staviski,\u00a0 who in August 2007 caused a road accident where a young man was killed and a young girl was left in a humiliating state of incapacity for the rest of her life,\u00a0 at least so far. The latest court decision became the reason for the present article. <\/span>Here <\/span><\/a>is the decision, as reflected in Bulgarian media.<\/span><\/p>\n

Here is a brief synopsis of the event and what happened in the following years:\u00a0 At around 19:45 h.\u00a0 in the evening of 5th August 2007,\u00a0 near the river of Ropotamo (south Black sea coast in Bulgaria) Staviski (who at the time was the advertisement face of BTV’s campaign entitled “If you have drunk,\u00a0 get off –\u00a0 I want to end this journey alive”)\u00a0 was driving his Hummer (a present for the world champion in figure ice-skating)\u00a0 over the speed limit and after drinking alcohol (test result –\u00a0 1.1\u2030, at 0.5\u2030 permitted by the law).\u00a0 As a result of the accident,\u00a0 23-year-old Petar Petrov from Sliven died,\u00a0 and Manuela Gorsova,\u00a0 18 at that time,\u00a0 remained in a state of coma.\u00a0 At the end of January 2008 the Court in Burgas announced its decision –\u00a0 2.5 years of suspended sentence with 5 years period of probation and 4 years deprivation of his driving rights,\u00a0 where the penalty for such cases provisioned by the law is between 3 and 12 years of effective imprisonment.\u00a0 Mr. Staviski’s defendants requested the so-called summary proceeding,\u00a0 for which the court needed to sentence below the statutory period.\u00a0 As per the court decision,\u00a0 Mr. Staviski had to pay compensation to the families of the two victims –\u00a0 BGN 90.000 to Petar Petrov’s parents and BGN 80.000 to Manuela Gorsova’s parents. Next year,\u00a0 the Appellate Court in Burgas and then the Supreme Court of Cassation changed the ruling to a certain extend,\u00a0 slightly increasing the sum of money the athlete had to pay to the victims’\u00a0 families (<\/span>here<\/span><\/a>).\u00a0 [In English.]<\/span><\/p>\n

And now,\u00a0 we are presented with the latest judicial masterpiece of a decision –\u00a0 the victim of a crime (not alleged,\u00a0 at that,\u00a0 mind you)\u00a0 is sentenced to pay the trial costs,\u00a0 because the court sentenced against her family’s claim demanding that the insurer of Mr.\u00a0 Staviski pay their daughter compensation for her injury and continuing treatment.\u00a0 The court’s motives are that the family paid for the victim’s treatment in Israel with money from donations.\u00a0 In everyday discourse,\u00a0 that sounds like a popular phrase of a literary character inhabiting the early independent years of Bulgaria:\u00a0 “You had plenty of cash, so you paid it.” (Bai Ganyo<\/span>,\u00a0 by Aleko Konstantinov)<\/span><\/p>\n

The fact that thousands of people and some companies,\u00a0 too,\u00a0 sympathised with the victim and her family,\u00a0 does not release the offender’s insurers from their obligation to cover her medical costs, say some law-practitioners. \u00a0 The fact may not,\u00a0 but that was exactly what the court did.<\/span><\/p>\n

A day after the publication of their decision,\u00a0 and the furious public reactions it arose,\u00a0 the court had to face the music,\u00a0 so to say,\u00a0 and make some announcement.\u00a0 The presiding judge stated that morality rarely has much to do with law.\u00a0 And so it seems.\u00a0 Next thing we ask ourselves may be if justice has anything to do with law.\u00a0 If not,\u00a0 why care for justice,\u00a0 or law?
